{"id":30819,"date":"2025-08-27T22:08:46","date_gmt":"2025-08-27T13:08:46","guid":{"rendered":"https:\/\/www.suaranewspapua.com\/?p=30819"},"modified":"2025-08-27T22:08:47","modified_gmt":"2025-08-27T13:08:47","slug":"mariyo-spokesperson-urges-constitutional-court-to-disqualify-candidate-pair-01-over-eligibility-violation","status":"publish","type":"post","link":"https:\/\/suaranewspapua.com\/index.php\/2025\/08\/27\/mariyo-spokesperson-urges-constitutional-court-to-disqualify-candidate-pair-01-over-eligibility-violation\/","title":{"rendered":"MARIYO Spokesperson Urges Constitutional Court to Disqualify Candidate Pair 01 Over Eligibility Violation"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Jayapura, August 27, 2025<\/strong> \u2013 The campaign team of Papua\u2019s gubernatorial candidate pair number 02, <strong>MARIYO<\/strong>, has rejected allegations of electoral fraud during the province\u2019s repeat election (PSU), instead accusing rival pair <strong>Benhur Tomi Mano\u2013Constan Karma (BTM\u2013CK)<\/strong> of committing what they described as \u201cbrutal fraud.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MARIYO spokesperson <strong>Dr. Muhammad Rifai Darus<\/strong> argued that Constan Karma\u2019s candidacy as deputy governor was legally flawed, as he previously served as Acting Governor of Papua from 2012 to 2013 \u2014 a position that, under Indonesian election law, should disqualify him from running.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe designation of Constan Karma as a deputy governor candidate is clearly an eligibility violation and can be classified as brutal fraud. Public opinion has been misled into believing that MARIYO engaged in wrongdoing, when in fact we have complied fully with the rules,\u201d Rifai said in a press statement on Wednesday (Aug. 27).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He cited <strong>Article 7(2)(o) of Law No. 10\/2016 on Regional Elections<\/strong> and <strong>Article 14(2)(n) of KPU Regulation No. 8\/2024<\/strong>, both of which prohibit anyone who has previously served as governor from running as deputy governor. He also referred to Constitutional Court rulings affirming that regardless of the title\u2014\u201cActing,\u201d \u201cCaretaker,\u201d or \u201cInterim\u201d\u2014the office carries the same rights and responsibilities as a governor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to Rifai, the root of Papua\u2019s repeat election controversy lies in the acceptance of Constan Karma\u2019s candidacy, not in alleged violations by MARIYO. \u201cThis undermines the principles of fair and lawful elections as enshrined in Article 22E of the 1945 Constitution,\u201d he added.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The MARIYO team has urged the Constitutional Court to consider the issue as a substantive violation warranting the disqualification of candidate pair 01. Rifai also called on Papuans to remain calm and safeguard democratic integrity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe appeal to the public to stay united and avoid provocation.
